Dear Valued Partners (Seller) and Valued Customers (Buyer),
To ensure that Fanpage/TikTok Channel buying and selling transactions fully comply with the provisions of Cybersecurity Law, Electronic Transactions Law, Intellectual Property Law and Advertising Law, our Agency hereby notifies the mandatory implementation conditions as follows:
I. FOR THE SELLER (Providing account to Agency)
Before handing over the account to the Agency, the Seller must ensure the following legal conditions:
1. Commitment to clean origin: The account must be legally owned/managed by the Seller. Absolutely no transaction of accounts obtained through fraud, forgery, unauthorized access or appropriation of others.
2. No violation history: The Seller guarantees that during the management period, the account has not been used to perform prohibited acts such as posting false information, infringing national security or violating public morals.
3. Clear content: The Seller is responsible for proactively removing all old posts, videos, images before handover [Lịch sử hội thoại]. However, the Seller must still be legally responsible for any consequences (if any) from past content.
4. Establishment by Electronic Contract: The Seller performs transaction confirmation via data message (OTP, Email, Electronic signature) so that the contract has legal validity equivalent to a paper document.
II. FOR THE BUYER (Receiving handover from Agency)
From the time of receiving the account management rights, the Buyer must comply with the following instructions to ensure rights:
1. Responsible for new content: Since the account is handed over in a blank content state, the Buyer is fully responsible before the law for all information, images, videos posted from the moment of receiving management rights.
2. Comply with Advertising Law: If using the account for business, the Buyer is responsible for checking advertising conditions, ensuring content truthful, accurate and not advertising prohibited goods, services.
3. Use legal brand name: The Buyer is entitled to use the received account name but must ensure no confusion about the characteristics, origin of goods, services compared to other protected trademarks or trade names.
4. Provide identification information: The Buyer must provide accurate information for the Agency to perform user verification according to cybersecurity regulations, to protect the account and meet the requirements of competent authorities when necessary.
